New charges filed against Plano hate crime suspect

A Plano man accused of committing a hate crime earlier this month is now facing additional felony charges stemming from a second alleged battery that occurred in November.

On Dec. 16, Dakota Malert, 21, 400 block of East Abe Street, and four other men were each charged with two counts of felony mob action for allegedly beating two men on Nov. 8, Kendall County court records show.

Immediately following the November incident, police charged Malert with two counts of misdemeanor battery for the crime. Last week, those charges were upgraded to felony mob action.

The new charges allege that Malert and four other men acted together when they beat two victims.

Also charged with two counts of felony mob action were Frank Faybik, 24, 300 block of West Main Street, Plano; Kevin Cox, 22, of Chicago; Christian Cervantes, 19, 400 block of East Abe Street, Plano; and Tyler Debolt, 21, 500 West Abe Street, Plano.

Earlier this month, on Dec. 10, Malert was charged with felony aggravated assault and a felony hate crime for allegedly assaulting a man based on his sexual orientation. That incident allegedly occurred on Dec. 5 at Malert’s Plano home, police said. Plano police said the incident was recorded and the video posted on the Internet.

Kendall County State’s Attorney Eric Weis said that although Malert was the only suspect alleged to have administered the beating, he might not be the only person to be charged in the hate crime incident.
